Rowena Edington, trading as Learnability ("we", "us" or "our"), is committed to protecting and respecting your privacy. This policy explains what personal data we collect, how we use it, and the rights you have over it.

Information we collect
You may give us information about yourself and/or your child by completing the contact form on our website, or by contacting us by telephone, email or other means. This may include your name, contact details and information about your enquiry.
If you engage our services, we will collect further information needed to carry out the work, such as background questionnaires, educational history, and the results of assessments or screenings.
We may also receive information about you and/or your child from third parties connected with your child's education, such as school SENCos and teachers, with your knowledge.
Our website contact form is provided by a third-party form service, which processes the details you submit in order to deliver them to us by email.
Special category data
Some of the information involved in our work - for example, information about a learner's specific learning difficulties or related health and developmental matters - is "special category data" under the UK GDPR. We process this data on the basis of your explicit consent, which you may withdraw at any time. Without it, we may be unable to provide our services.
How we use your information and our lawful bases
We use the information we collect:
- To provide the services we have agreed with you, such as assessments, screenings, tuition and training (lawful basis: performance of a contract)
- To carry out and report on assessments involving information about specific learning difficulties (lawful basis: your explicit consent)
- To respond to enquiries and communicate with you about our work together (lawful basis: performance of a contract, or legitimate interests)
- To liaise with your child's school or other professionals, where you have authorised this (lawful basis: consent)
- To keep records we are legally required to keep, for example for tax purposes (lawful basis: legal obligation)
- To send you information about our services, where you have agreed to receive it - you may opt out at any time (lawful basis: consent)
Sharing your information
We will only share your information with your authorisation - for example, sharing a report with your or your child's school/college at your request and speaking with your child's school/college.
We may also disclose personal information where we are under a legal duty to do so, or where disclosure is necessary to protect the rights, property or safety of our clients, ourselves or others.
We do not sell personal information to anyone.
Cookies
Our website stores your choice about cookies so the notice is not shown to you repeatedly. It does not use advertising cookies. We may use Google Analytics to help us understand how visitors use our website - for example, which pages are visited most. Analytics cookies are only set if you accept them through the cookie notice on our website; the information collected is aggregated and does not directly identify you, and you can decline them without affecting your use of the website.
How we store your information and for how long
We retain assessment records for these periods to comply with our professional obligations, meet legal and insurance requirements, respond to any future queries regarding an assessment, and defend potential legal claims where necessary.
Children: Assessment reports, questionnaires and consent records can be retained until the client reaches the age of 24. This reflects PATOSS legal guidance and the limitation periods that may apply once the individual reaches adulthood.
Adults: Assessment reports, test record forms, scoring sheets, working papers and consent records are retained for 6 years following completion of the assessment, in line with PATOSS guidance and the Limitation Act 1980.
Records are stored securely using encrypted electronic storage and/or locked physical filing systems. Access is restricted to authorised personnel only.
International transfers
We are based in the United Kingdom and do not transfer your personal data outside the UK, except that our website form provider may process form submissions on servers outside the UK and Google may process analytics data where analytics are in use, on servers outside the UK with appropriate safeguards in place under the UK GDPR.
Your rights
Under the UK GDPR, you have the right to:
- Access the personal data we hold about you (a "subject access request") - this is free of charge and we will respond within one month
- Have inaccurate personal data corrected
- Have your personal data erased, in certain circumstances
- Restrict or object to our processing of your personal data, in certain circumstances
- Receive a copy of the data you provided to us in a portable format, in certain circumstances
- Withdraw consent at any time, where our processing is based on consent
